Zavo Software Services LLC, doing business as Zavo Health, and our affiliates and subsidiaries ("Zavo Health," "we," "us," or "our") understand the importance of safeguarding your information privacy. This Privacy Policy gives you key details about the privacy practices that apply to the Zavo Health software, website services, and any website, application, product, or service.
About This Privacy Policy
This Privacy Policy applies to any information that, by itself or together with other information, may be used to readily identify, contact, or locate an individual ("Personal Information") in our possession. "Personal Information" also includes identifiable health information collected about you. We do not treat as Personal Information data that has been anonymized so a third party cannot easily identify a specific person.
Additionally, individually identifiable information you provide to us for delivering medical care to your prospective or current patients ("Protected Health Information" or "PHI") is also subject to each Provider's Health Insurance Portability and Accountability Act Notice of Privacy Practices (the "HIPAA Notice").
This Privacy Policy does not describe Providers' privacy practices, and Zavo Health is not responsible for our Providers' privacy policies or practices.
Collection of Information
We may collect the following types of information (including Personal Information and your Patients' PHI) when you use the Zavo Health Services:
Information you or the Patients provide directly to us
For certain activities, such as when Patients register, use our online services (through our websites or applications), use our telemedicine services, subscribe to alerts, or contact us directly, we may collect some or all of the following information:
- Contact details, such as your and the Patients' full name, email address, mobile number, and address;
- Username and password;
- Payment details, such as your or the Patients' credit card number, expiration date, and card security code;
- Employment-related information, such as your job title, practice area, primary specialty, and medical license status, gender, date of birth, languages spoken, educational background, address, photograph, social security number, Tax ID, NPI number, professional license information, and bank account information;
- Personal health information, including details about the Patient's diagnosis, prior treatments, general health, health insurance, and information that you or the Patients have stored in Apple HealthKit (to the extent they choose to sync that data with our services); and
- Any other information you submit to us.
Information we collect automatically
Zavo Health and our third-party partners, such as analytics providers, may automatically collect certain information when you use our Zavo Health Services, such as your Internet protocol (IP) address, device and advertising identifiers, browser type, operating system, internet service provider, pages visited before and after using the Zavo Health Services, the date and time of a Patient's visit, details about links clicked and pages viewed within the Zavo Health Services, and other standard server log data. We may also collect certain location data when you use our Zavo Health Services, such as your computer's IP address, your mobile device's GPS signal, or information about nearby Wi-Fi access points and cell towers.
We may use cookies, pixel tags, Local Shared Objects, and similar technologies to automatically collect this information. Cookies are small pieces of information stored by your web browser. Pixel tags are very small images or data snippets embedded in images, also called "web beacons" or "clear GIFs," that can detect cookies, the date and time a page is viewed, a description of the page where the pixel tag appears, and similar information from your computer or device. Local Shared Objects (sometimes called "Flash Cookies") are like standard cookies but can be larger and are downloaded to a computer or mobile device by the Adobe Flash media player. By using the Zavo Health Services, you consent to our use of cookies and similar technologies.
We may also collect technical data to identify and resolve technical issues and improve our Zavo Health Services, including your device's memory state when a system or app crash occurs while using our Zavo Health Services. Your device or browser settings may allow you to control collection of this technical data. This data may include portions of a document you were using when an issue occurred, or the contents of your communications. By using the Zavo Health Services, you consent to this technical data collection.
Information we receive from healthcare providers and other sources
In connection with a Patient's treatment, we may collect medical records from their past, current, and future healthcare providers. This may include information about diagnosis, prior treatments, general health, laboratory and pathology test results and reports, social histories, family illness history, and records of phone calls and emails related to their illness.
Some of our users, including Providers, are subject to laws and regulations governing use and disclosure of health information they create or receive. These include the 21st Century Cures Act, HIPAA, the Health Information Technology for Economic and Clinical Health Act of 2009 ("HITECH"), and related regulations. When we store, process, or transmit "individually identifiable health information" (as defined by HIPAA) on behalf of a Provider that has entered into a Healthcare Provider User Agreement, we do so as that Provider's "business associate" (as defined by HIPAA). Under this agreement, Zavo Health is prohibited from using individually identifiable health information in ways the Provider itself could not. Zavo Health must, among other obligations, apply reasonable and appropriate safeguards to protect the confidentiality, integrity, and availability of individually identifiable health information we store and process on behalf of such Providers.
We may also receive information about you from other sources, including third-party services and organizations. We may combine first-party data, such as your email address or name, with third-party data from other sources and use this to contact you. For instance, if you access third-party services such as Facebook, Google, or Twitter through the Zavo Health Services to log in to the Zavo Health Services or to share information about your experience on the Zavo Health Services with others, we may collect information from those third-party services.
Use of Information
Our uses for information (including Personal Information) collected online include, but are not limited to:
Cookie Types
- Targeting Cookies: These cookies may be placed through our site by our advertising partners. They may be used by those companies to build a profile of your interests and display relevant ads to you on other websites. They do not directly store personal information, but rely on uniquely identifying your browser and internet device.
- Functional Cookies: These cookies allow the website to deliver enhanced functionality and personalization. They may be set by us or by third-party providers whose services we have added to our pages.
- Performance Cookies: These cookies let us count visits and traffic sources so we can measure and improve site performance. They help us understand which pages are most and least popular and how visitors move through the site. All information these cookies collect is aggregated and therefore anonymous.
- Strictly Necessary Cookies: These cookies are required for the website to operate and cannot be turned off in our systems. They are usually set only in response to actions you take that amount to a request for services, such as setting privacy preferences, logging in, or filling out forms.
How We Use Your Information
- Providing and enhancing the Zavo Health Services;
- Contacting you;
- Fulfilling your requests for products, services, and information;
- Sending you information about additional clinical services or general wellness from us or on behalf of our affiliates and trusted third-party partners;
- Analyzing use of the Zavo Health Services and user data to understand and improve the Zavo Health Services;
- Customizing the content you see when you use the Zavo Health Services;
- Conducting research using your information, which may be subject to your separate written authorization;
- Preventing potentially prohibited or unlawful activities and otherwise acting in accordance with our Terms of Service; and
- Any other purposes disclosed to you when we collect your information or pursuant to your consent.
Communications
By using the Zavo Health Services, you agree to receive texts, phone calls, and/or emails from us at the phone numbers and email addresses you have provided for informational and customer-service-related purposes.
Mobile numbers will not be shared with third parties for sending their own marketing messages. Text messaging originator opt-in data and consent will not be shared with any third parties, except that this does not apply to sharing (1) with service providers who need access to this information to support the Zavo Health Services; (2) if we believe disclosure is required by applicable law, rule, or regulation, or to comply with law enforcement or legal process; and (3) if the user consents to our sharing of such information.
We may anonymize and aggregate any data collected through the Zavo Health Services and use it for business purposes, such as evaluating and profiling Zavo Health Services performance, including analyzing usage trends and patterns and measuring the effectiveness of content, features, or services.
Security
We use reasonable measures to help protect information against loss, theft, misuse, and unauthorized access, disclosure, alteration, and destruction. You should understand that no data storage system or internet/public-network data transmission can be guaranteed as 100% secure. As a result, we cannot guarantee or warrant the security of information you transmit to us, and you do so at your own risk.
Once we receive your transmission, we take steps to secure our systems. Please note this is not a guarantee that such information cannot be accessed, disclosed, altered, or destroyed through a breach of these safeguards.
If Zavo Health becomes aware of a security system breach, Zavo Health maintains an incident response policy that includes notifications consistent with applicable law.
By using the Zavo Health Services or providing Personal Information to us, you agree that we may communicate with you electronically regarding security, privacy, and administrative matters related to your use of this website.
Your Choices
You may opt out of receiving certain general communications by emailing privacy@zavohealth.com. You may also request deletion of your Personal Information by emailing privacy@zavohealth.com.
You may be able to reject or disable cookies through your web browser settings. Since each browser is different, please review your browser's instructions (typically in the "help" section). Please note that additional steps may be required to reject or disable Local Shared Objects and similar technologies.
When you visit any website, it may store or retrieve information in your browser, mostly as cookies. This information may relate to you, your preferences, or your device and is mostly used to make the site work as expected. Because we respect your privacy rights, you can choose not to allow some cookie types. However, blocking some cookie types may affect your experience of the site and the services we can provide.
California residents are entitled once per year, free of charge, to request and obtain certain information regarding our disclosure, if any, of certain categories of Personal Information to third parties for those parties' direct marketing purposes in the prior calendar year. We do not share Personal Information with third parties for their own direct marketing purposes.
Third-Party Advertising, Links and Content
Some Zavo Health Services may include links to content maintained by third parties we do not control. We permit third parties, including business partners, ad networks, and other advertising service providers, to collect information about your online activities through cookies, pixels, local storage, and other technologies. These third parties may use this information to display ads on our Zavo Health Services and elsewhere online tailored to your interests, preferences, and characteristics. We are not responsible for these third parties' privacy practices.
To opt out of interest-based advertising across browsers and devices from companies participating in the Digital Advertising Alliance or Network Advertising Initiative opt-out programs, visit their websites. You may also be able to opt out through settings in the mobile app or your mobile device.
Do-Not-Track Signals and Similar Mechanisms: Some web browsers send "do-not-track" signals to websites. Because browsers implement and enable this feature differently, it is not always clear whether users intend to send these signals or are even aware they are being sent. We currently do not respond to these signals.
Third-Party Browser Extensions: Extensions are small third-party software programs that can modify and enhance browser functionality. These extensions are installed by users in browsers on their own computers and are used at users' own risk. Such extensions are not affiliated with Zavo Health, and Zavo Health has no visibility into which extensions users may use. Zavo Health assumes no risk for data loss or breach due to your use of browser extensions.
Before using the Zavo Health Services, if you have one or more of these extensions enabled in your browsers, Zavo Health recommends fully removing all such extensions immediately, as merely disabling them may not sufficiently protect your PHI.
Intended For Use in United States Only
The Zavo Health Services are intended for use only from and within the United States. Accordingly, Zavo Health makes no representations or warranties that the Zavo Health Services comply with laws outside the United States, and Zavo Health is not responsible for your use of the Zavo Health Services outside the United States.
Zavo Health stores information in the United States and in accordance with U.S. law, which may not provide the same protections as laws in your jurisdiction. By using the website and providing information to us, you understand and agree that your information may be transferred to and stored on servers outside your home jurisdiction.
In certain circumstances, we may be required to disclose personal data in response to lawful requests from public authorities, including to meet national security or law enforcement requirements.
Children
We do not knowingly permit individuals under age 18 to create accounts that allow access to our Zavo Health Services.
Without limiting the above, the Zavo Health website does permit persons over age 18 -- such as you, parents, and guardians -- to provide, share, and store Personal Information about others, including minors and children. Any user who provides, stores, or submits information on behalf of a child assumes full responsibility for the submission, use, and transmission of that information.
Changes and Updates to the Privacy Policy
We may revise this Privacy Policy from time to time, and the updated version will be effective as of the date it is posted. When we update this Privacy Policy, we will revise the "Effective Date" above and post the new Privacy Policy. We recommend reviewing this Privacy Policy each time you visit the Zavo Health Services so you stay informed about our privacy practices.
Your use of our websites, including continued storage of your information, after any such change constitutes your agreement that all information collected from or about you through our websites will be subject to the revised Privacy Policy terms.
Information Retention
Zavo Health's collection, use, and disclosure of information are generally governed by service agreements with Providers. Information maintained to provide these services is retained only as long as we have a legitimate business purpose and in accordance with applicable law.
Zavo Health may retain archived information for seven years (or longer if required by law) as needed to comply with legal obligations, resolve disputes, enforce our agreements, and support other authorized uses under this Privacy Policy.
Zavo Health stores non-personal information indefinitely, as well as any feedback you provide to us.
